Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EasyPassy website at easypassy.app and the EasyPassy digital business card service (the "Service"), operated by EasyPassy ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

EasyPassy is a digital business card generator that creates Apple Wallet passes containing your professional contact information. The Service allows you to create, customize, and share digital business cards that can be added to Apple Wallet and shared via QR code scanning.

2. Account Registration

To use the Service, you must:

• Sign in using a valid Google account
• Provide accurate and complete information
• Be at least 13 years of age
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. You must notify us immediately at support@easypassy.app if you suspect unauthorized use of your account.

3. Free Trial

New users receive one free digital business card with limited features. The free trial allows you to experience the core functionality of the Service. Free trial passes may have limited validity periods and reduced features compared to paid passes.

4. Pricing and Payments

• Paid features are available through a one-time payment processed by Stripe.
• All prices are displayed in US Dollars (USD) unless otherwise stated.
• Payment is due at the time of purchase. You will not be charged recurring fees.
• Promotion codes and discounts may be offered at our sole discretion and may be subject to additional terms.
• Prices are subject to change. Any price changes will not affect existing purchases.

5. Lifetime Access

When we refer to "lifetime" access or a "lifetime" pass, this means access for the duration that the EasyPassy service is actively maintained and operated. Specifically:

• "Lifetime" means the lifetime of the EasyPassy product and service, not the lifetime of the user.
• The Service may be discontinued with a minimum of 90 days advance notice to all users via email.
• "Lifetime" does not guarantee perpetual availability — it means no recurring subscription fees for the duration of the Service.
• We reserve the right to modify, update, or enhance features with reasonable notice. Core functionality (generating and sharing digital business cards) will be maintained.

6. Refund Policy

We offer a 30-day money-back guarantee from the date of purchase. If you are not satisfied with the Service, you may request a full refund within 30 days by contacting support@easypassy.app. Refund requests made after 30 days will not be honored. Refunds are processed via the original payment method through Stripe.

7. Acceptable Use

You agree not to use the Service to:

• Create business cards containing false, misleading, or fraudulent information with intent to deceive
• Impersonate another person or entity
• Include illegal, offensive, discriminatory, or harmful content on your business card
• Upload malicious files, viruses, or harmful code
• Attempt to gain unauthorized access to our systems, other users' accounts, or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scrapers to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Violate any applicable local, national, or international law or regulation

8. User Content

You retain ownership of all content you provide to the Service (names, photos, logos, contact details). By using the Service, you grant us a limited, non-exclusive, worldwide license to use, store, process, and display your content solely for the purpose of providing and operating the Service. This license terminates when you delete your account or content.

You are solely responsible for the accuracy, legality, and appropriateness of the content you include on your business card. We do not endorse or verify user content.

9. Intellectual Property

The Service, including its design, code, branding, logos, and documentation, is owned by EasyPassy and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. The EasyPassy name, logo, and ninja mascot are trademarks of EasyPassy.

10. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime. We are not liable for any interruption or loss of service.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EASYPASSY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE US DOLLAR ($1.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless EasyPassy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any rights of a third party, or any content you provide through the Service.

14. Termination

• You may delete your account at any time by contacting us at support@easypassy.app.
• We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.
• Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.

15. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved as follows:

• Informal resolution: Before filing any formal claim, you agree to contact us at support@easypassy.app and attempt to resolve the dispute informally for at least 30 days.
• Governing law: These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EasyPassy regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by sending an email to the address associated with your account. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
